IBC urges Alta. to allow exclusion

While amendments to Alberta’s Insurance Act have met with general approval, stakeholders have expressed concerns about some regulations awaiting proclamation. Most industry responses to a consultation call from the Superintendent of Insurance sought a transition period of at least six months from approval to enforcement of the regulations. The Alberta brokers’ association said it would need time to revise educational materials and programs. The Insurance Bureau of Canada urged the government not to ban exclusions for fire following earthquake. Although earthquake is not considered a major risk in Alberta, its Insurance Act and regulations have been developed in tandem with B.C. — where the IBC would like to head off what is widely perceived to be an inclination toward such a ban. “Given the intention of other jurisdictions to harmonize their Insurance Act legislation and regulations, it is very likely that a regulation adopted in Alberta will be replicated in other provinces and territories,” the IBC brief noted. It said a serious B.C. earthquake causing widespread insurable fire claims could force insurers to raise premiums across the country. “As the first jurisdiction slated to amend the Insurance Act regulations, we urge the Alberta government to seriously consider the potential negative impact on consumers across the country were a prohibition on excluding fire following earthquake to become the norm in Canada.” Comments from a number of companies and other stakeholders in our January 18, 2010 edition.
