N.S. cap change expected soon

With the stakeholder submission stage of Nova Scotia’s review of its cap on awards for minor auto accident injuries now complete, at least one Halifax lawyer believes changes will likely be announced before the summer. “We don’t know what changes the government will make to the $2,500 cap,” David Brennan said last week. “During the election, Premier Dexter said that he favoured a replacing the $2,500 cap with a deductible, which is the current system in Newfoundland and Labrador. “(He) spoke about the possibility of a $10,000 to $15,000 deductible.” Meanwhile, in its submission for the province’s review of the cap, the Nova Scotia Coalition Against No-Fault Insurance says it should be removed. Retroactively. There shouldn’t be limitations or restrictions placed on pain and suffering awards other than those determined by the courts. And the coalition says insurers should be publicly admonished for misleading the people on the financial health of the industry. The IBC says insurers are prepared to operate within the range of possible insurance systems that the government determines will best serve the province’s consumers. It warns that eliminating or undertaking major changes to the cap on pain and suffering awards for minor injuries presents a risk to the current rate stability, affordability, and availability of auto insurance.
